1.Legal Nature of Services

BSK Caregivers operates solely as a private home-care staffing agency. We are not a hospital, clinic, diagnostic center, or medical practice. We do not employ doctors, provide medical consultations, or offer diagnoses. Our role is strictly limited to connecting verified caregivers with clients.

2. Individual Responsibility of Caregivers

All caregivers act independently. Any act of negligence, error, or misconduct by an individual caregiver is solely the legal responsibility of the caregiver and the client. BSK Caregivers holds no liability under any circumstances.

3. Limitation of Liability – Medical Outcomes

BSK Caregivers does not guarantee recovery, health improvements, or specific medical outcomes. Services are strictly based on instructions from licensed PMDC/PMC doctors. Any dissatisfaction or health progression is the client’s responsibility.

4. Property and Valuables

Clients are fully responsible for securing cash, jewelry, documents, and other valuables. BSK Caregivers accepts no liability under any circumstances for theft, loss, or damage, and cannot be held legally responsible in any court, anywhere.

5. Medical Compliance

Caregivers will strictly follow written and signed instructions from licensed PMDC/PMC doctors.
Caregivers are prohibited from prescribing, administering, or altering any medication or medical procedure beyond the doctor’s instructions. Any unauthorized action is entirely the client’s legal responsibility.

6. Emergency & Accident Disclaimer

BSK Caregivers is not an emergency response unit. In life-threatening situations, clients must immediately contact 1122 or transport the patient to a hospital. BSK Caregivers is not liable for any complications, accidents, or death due to natural causes, medical emergencies, or unauthorized procedures.

7. Staff Verification & Credentials

All staff are verified for identity, criminal background, and professional credentials. While we strive for reliability, human error cannot be fully eliminated. Clients acknowledge that BSK Caregivers cannot guarantee flawless performance.

8. Service Termination

BSK Caregivers reserves the right to withdraw staff immediately if:

Staff faces harassment or unethical behavior.

Patient’s condition requires hospital-level care.

Safety or professional standards are compromised.

9. Privacy & Data Protection

Client and patient information is confidential. We comply with Pakistan privacy laws and maintain secure digital records. No data is shared without consent, except as legally required.

10. Payment, Booking & Cancellation

Services are confirmed upon full payment or agreed installment.

Cancellation must be requested at least 24 hours prior. Late cancellations may incur fees.

Additional charges may apply for overtime, special requests, or emergency changes.

11. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of Pakistan. Any dispute shall first be resolved through arbitration or mediation. BSK Caregivers cannot be held liable in any court, in Pakistan or elsewhere, for any claims, actions, or damages arising from services provided.

12. Acceptance of Terms

By booking services through BSK Caregivers’ website, phone, or other channels, clients confirm that they have read, understood, and accepted these Terms and Conditions. Clients agree not to pursue legal action against BSK Caregivers for the actions, errors, or negligence of caregivers, or for the patient’s natural health progression.

13. Client Conduct & Responsibility

Clients and guardians must behave ethically and respectfully. Any coercion, harassment, or forcing caregivers to act beyond their professional limits makes the client solely responsible for all consequences.

14. Arbitration & Dispute Resolution

Any disagreement, claim, or complaint must first be addressed through written notice and arbitration. Legal action is allowed only after arbitration fails. This ensures BSK Caregivers remains protected from unnecessary court cases.

15. Comprehensive Liability Waiver

By using BSK Caregivers’ services, the client explicitly agrees that BSK Caregivers assumes zero liability for:

Caregiver errors or negligence

Medical outcomes or deterioration

Theft, loss, or damage to property

Accidents or emergencies at home

Any other claim, action, or damage

This waiver applies globally, in Pakistan or anywhere else.
